Are jobs with TrueBlue different than jobs with one of your companies?

Yes, working for TrueBlue is different than working at one of our brands or for one of our clients. If you work at TrueBlue, you work in our corporate offices where we run the support operations for all our brands. Working for one of our brands (i.e. PeopleReady, Staff Management | SMX, etc.) means you work for a company within the TrueBlue parent corporation, serving the clients of that brand. Each one of our brands has its own set of careers and systems.

What types of jobs do you offer?

TrueBlue offers a huge variety of jobs – it all depends on what you’re interested in. At our corporate offices, we offer jobs in a support center setting for careers such as marketing, IT, accounting, recruiting, HR, and training. We also have operational jobs interacting with our clients and workers daily. These jobs tend to revolve around sales, recruiting or service. If you want to work with one of our clients, your possibilities are endless! We work in a variety of industries and need a large range of skill levels; there is something for everyone.

What is your application process?

Our application process varies slightly from company to company and depends on which type of job you are interested in. All our applications ask for your relevant work history, skills and experience. Past that, any additional information will depend on the type of job you are seeking. Various screenings, like drug tests or background checks, may also be part of the process depending on the job type. Our applications are available online for each of our companies.

If you want to work for TrueBlue or at one of our companies, you’ll complete an application process administered by our HR and Recruiting teams. If you are interested in working for one of our clients, you will complete the application process with our company offering the job. Once you apply for a job within a company, you do not have to redo the application if you want to apply to another opening. For example, if you apply for a payroll job at TrueBlue, you do not have to redo an application to also apply for a job in accounting. This is true for each of our brands, but is not available across them. If you want to apply for jobs at both PeopleReady and Centerline for example, you’ll need to fill out an application for each company.

Is TrueBlue the parent corporation? How are all your companies related?

TrueBlue is the parent company for PeopleReady, Centerline, SIMOS, Staff Management | SMX, and PeopleScout, providing guidance and oversight as well as back office support to all our companies.

While each of our companies has its own sales and recruiting teams and often its own book of business, we can bring all our capabilities together to meet our clients’ needs. You can also visit the websites of the TrueBlue companies for additional job opportunities.

Terms and Conditions

These Terms & Conditions (“Agreement”) govern your use of and access to websites (including www.trueblue.com and any other website where this Agreement is posted), applications (including mobile applications), and content (the “Services”) made available by TrueBlue, Inc. or one of its subsidiaries or affiliates (“TrueBlue”, “we”, “our”, or “us”). TrueBlue may, in its discretion, modify, supplement or amend this Agreement as it relates to your use of the Services from time to time, for any reason, and without any prior notice or liability to you or any other person.

1. Acceptance of This Agreement

Your use of OR access to the Services constitutes your acceptance of this Agreement. If you do not want to agree to this Agreement in its entirety, do not access or use the Services.

2. Amendments to This Agreement

TrueBlue reserves the right, in its sole and absolute discretion, to change, modify, update, add or remove portions of this Agreement at any time. The new or modified terms will take effect immediately upon posting. When material changes are made to the Agreement, the changes will be effective after you provide your consent, or after you continue to use the Services. You should review this Agreement every time you visit TrueBlue’s website or use the Services. If you do not agree to the amended terms, you must stop using the Services.  

3. Scope of This Agreement

TrueBlue collects, uses and discloses information regarding your use of the Services and your personal information in accordance with TrueBlue’s Privacy Policy which may be found at www.trueblue.com/Privacy-Policy, which is incorporated into this Agreement by this reference. This Agreement, the Privacy Policy, and all other agreements that you, or any persons you represent, have with TrueBlue or its service providers, suppliers, or contractors (“Providers”), now or in the future, together constitute the entire agreement regarding your access to and use of the Services, and supersede all previous agreements, whether written or oral, regarding your access to and use of the Services. In the event of any inconsistency or conflict between the provisions of this Agreement and the provisions of any other agreement that you have with TrueBlue or its Providers, now or in the future, the provisions of this Agreement shall govern regarding your access to and use of the Services.

This Agreement is in addition to and supplements any written agreements, if any, that you or any persons you represent have with TrueBlue or its Providers, now or in the future.

4. Calling and Texting Services

By providing your contact information and using the Services, you hereby affirmatively consent to our use of your contact information for calls and texts in order to perform and improve upon the Services. By providing your mobile phone number through the Services, you give your express prior consent, or prior express written consent, for the Services to include our calling and text messaging (SMS) services (“Calling and Texting Services”), including as noted in this section. The Calling and Texting Services may include calling or sending text messages from TrueBlue and its Providers regarding, among other things, potential job assignments, career advancement, safety information, job matching services, and recommendations to local educational, training, and volunteer opportunities. 

You acknowledge and agree that your consent for the Calling and Texting Services means that calls and texts may be sent by TrueBlue or its service providers using an automatic telephone dialing system or an artificial or pre-recorded voice.

You may terminate the Texting Services at any time, for any reason, by texting “STOP” to short code 42800, in which case you may receive an auto-reply text message confirming such termination. You may also terminate the Texting Services by notifying your local branch.

Please note that message rates, voice, and data charges from your cellular service provider may apply in connection with the Calling and Texting Services. You are solely responsible for such message, voice, and data charges. If you are an employee of TrueBlue, Inc. or one of its subsidiaries and you incur message, voice, or data charges directly related to your employment and the Services, TrueBlue will reimburse you for those charges. If you would like to be reimbursed for those charges, please contact your local branch.

If, at any time, you cancel or change your mobile telephone number, you agree to promptly notify TrueBlue of that change so that TrueBlue may update its records to avoid sending text messages to an individual that may later be assigned your telephone number. You agree to indemnify, defend, and hold TrueBlue, its Providers, and their respective affiliates, subsidiaries, agents and parents harmless from any and all liability, including any legal fees and expenses that TrueBlue may incur, as a result of your failure to notify TrueBlue of your cancellation or change in mobile telephone number.

5. Restrictions

The Services may contain profiles, email systems, blogs, message boards, applications, job postings, chat areas, news groups, forums, communities and/or other message or communication facilities (“Public Areas”). You may only use such Public Areas to send and receive messages and material that are relevant and proper to the applicable forum. You understand that all submissions made to Public Areas will be public and that you will be publicly identified by your name or login identification when communicating in Public Areas, and TrueBlue will not be responsible for the action of any users with respect to any information or materials posted in Public Areas. You may not use the Services to do any of the following: 

• Harass or encourage harassment of another person; 
• Perform any activities that violate, intentionally or unintentionally, any applicable state, local, federal, or international laws or regulations; 
• Infringe any patent, trademark, trade secret, copyright, or other intellectual property or violate other rights (including privacy or publicity) of any other person; 
• Perform any activities that are misleading, malicious, discriminatory, infringing, or could expose TrueBlue, its subsidiaries or users of the Services to harm or liability; 
• Transmit any material or act that is hateful, threatening, abusive, tortious, defamatory, inflammatory, false, fraudulent, misleading, libelous, vulgar, obscene, pornographic (or that contains nudity), graphically or gratuitously violent, that violates anyone’s rights including intellectual property rights or proprietary rights, or is otherwise objectionable in TrueBlue’s sole judgment; 
• Provide resources to or otherwise support any organization(s) designated by the United States government as a foreign terrorist organization under section 219 of the Immigration and Nationality Act; 
• Impersonate any person or misrepresent in any way your affiliation with a person; 
• Transmit unsolicited mass mailings, “spam” or advertising or promotional materials; 
• Conduct contests, sweepstakes, or lotteries; • Collect or store any information about other users, other than in the normal course of using the Services for its intended purpose; 
• Transmit any virus, worm, defect, Trojan horse, or any other similar destructive or harmful item, or automated means, information, or computer code that interrupts, destroys, or limits the functionality of any computer or telecommunications equipment; 
• Use in any manner that could damage, disable, overburden, disrupt or impair the Services, or the network(s) connected to TrueBlue’s website, or interfere with any other party’s use of the Services; 
• Disobey any applicable policies or regulations of networks connected to the Services; • Modify, adapt, translate, reverse engineer, decompile or disassemble the Services; 
• Use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion of the Services; 
• Use an iFrame or offer web search functionality on TrueBlue’s website; 
• Frame, reformat or otherwise make the Services available to third-parties; 
• Create user accounts using any automated means or under false pretenses; 
• Prepare derivative works based on the Services; or 
• Remove any proprietary notices, labels or other identifying marks on content provided through the Services.

6. Mobile Application

In addition to the other requirements in this Agreement, there are some additional requirements that are specific to the mobile application portion of the Services (“App”). The App has interactive features that allow users to post and share content including, but not limited to, job listings (including desired worker skills, hours and pay, work site locations and business details), ratings of workers and businesses, and worker preferences (including personal information, location, desired travel parameters, skills and certifications), (all, collectively, “User Content”). All User Content must comply with Section 5 (Restrictions) of this Agreement. You understand that no User Content will be considered proprietary or confidential.

TrueBlue is not responsible, or liable to you or any third party, for the contents or accuracy of any User Content.

TrueBlue has the right, in its sole discretion, to:

• Remove or block any User Content for any or no reason; 
• Take any action with respect to any User Content that it deems necessary or appropriate in its sole discretion, including if TrueBlue believes that such User Content violates this Agreement, violates intellectual property or other rights of it or third parties, poses a safety threat, or creates potential liability for TrueBlue; 
• Disclose the identity or other information about any individual who provides or distributes User Content to courts, regulators, law enforcement authorities, or to any third party that alleges a violation of law or of their privacy or intellectual property rights; 
• Terminate or suspend use of the App for any or no reason, including without limitation, suspected violation of this Agreement.

While TrueBlue has the rights above, it undertakes no obligation to review or monitor User Content, and it disclaims all liability for any action or inaction with respect to User Content. In addition to the terms stated herein, the terms of service of the App will apply.

7. Account Security

You are solely responsible for maintaining the confidentiality of your phone number, username, password and other access information or codes for the Services. In addition, you are fully responsible for all activities that occur under your username, password and other access information or codes, even where your username, password or other access information or codes are used by someone else. 

You shall: (a) notify us without delay of any unauthorized disclosure or use of your username, password or other access information or codes or any other breach of security of which you become aware, and (b) if you are using the Services, ensure that you are sufficiently disconnected and logged off from your account at the end of each session. Particular caution should be exercised when accessing your account from a public or shared computer. 

8. License

You represent and warrant that information and User Content you provide through the Services or otherwise is not subject to any confidentiality obligations and that you own and control all of the rights to the information and User Content. By submitting or posting any information or User Content through the Services, you grant TrueBlue a worldwide, perpetual, irrevocable, non-exclusive, fully-paid up and royalty free license to use the information subject to this Agreement and the Privacy Policy. By providing or making available information or User Content in connection with the Services, you hereby release TrueBlue from any claims that such use, as set forth above and in this Agreement and the Privacy Policy, violates any of your rights and you understand that you will not be entitled to any compensation for use of information or User Content.   

9. International Use

Any information, including personal information, that TrueBlue collects in providing the Services may be controlled, stored and processed in, and transferred among, any of its facilities and may be transferred to and through any country, including the Republic of Mexico and countries outside the European Economic Area which may not have privacy or data protection legislation and regulations comparable to the laws of the country in which you reside. Any information, including personal information, that TrueBlue collects in providing the Services may be controlled, stored, processed by, and transferred among third-party vendors or contractors TrueBlue engages to assist us in providing the Services. The location of our facilities and of such contractors may change from time to time, and we may acquire new facilities and contractors. You expressly consent to all such control, storage, processing and transfers. 

10. Eligibility

You must be 18 years of age or older to use the Services. By accessing the Services, you certify that you are 18 years of age or older. If we discover or have any reason to suspect that you are not at least 18 or that you have knowingly provided false information to us, TrueBlue reserves the right to suspend or terminate your use of the Services immediately and without notice. 

By accessing the Services, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by this Agreement and TrueBlue’s Privacy Policy.  

11. Communications and Orders

The Services are a portal and information conduit to other websites and services offered by TrueBlue or its Providers. By activating certain links, including order-related links, you may be automatically connected with websites operated by Providers. If you use the Services to initiate communication regarding your staffing needs, the information you submit may be disclosed to, processed by or responded to by Providers.

All communications you submit to TrueBlue through the Services or by email must be true, accurate and complete. TrueBlue and its Providers will rely upon the truth, accuracy and completeness of the communications you submit through the Services. If you submit any incorrect or incomplete communications, or if any communications are damaged or distorted during transmission to TrueBlue, you and all persons you represent will be liable for any loss, damage or additional costs that you, TrueBlue, Providers, or any other persons may incur as a result.

You authorize TrueBlue and its Providers to: (a) accept communications they receive from you by means of the Services or other form of communication as if those communications had been given directly by you in writing and signed by you; (b) disclose your communications to any of its Providers and TrueBlue employees by means of the Services, email or other communications; and (c) respond to your communications by means of email or other communications. Communications you send to TrueBlue by means of the Services or other form of communication are not effective unless and until they are processed by the responsible TrueBlue representative.

TrueBlue may refuse to process any communications sent to TrueBlue at any time in TrueBlue’s discretion, and without any notice or liability to you or any other person, including, without limitation, if: (a) TrueBlue cannot process the communications; (b) the communications violate any provision in this Agreement or any other agreement that you or any other person may have with TrueBlue; (c) TrueBlue considers that the communications conflict with any other instructions or agreements with you or any person you represent; or (d) there is an operational failure or malfunction in connection with the transmission of the communications.   

12. No Advice

The Services are not intended to provide legal guidance or other expert advice on labor or employment matters, including, without limitation, those related to hiring practices, non-discrimination, wage and hours, taxes, or benefits. You should seek appropriate and qualified professional advice on such matters.  

13. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND WITHOUT ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, AND INCLUDING WITHOUT LIMITATION REPRESENTATIONS, WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PRIVACY, SECURITY, PERFORMANCE, DURABILITY, AVAILABILITY, TIMELINESS, ACCURACY OR COMPLETENESS, ALL OF WHICH ARE HEREBY DISCLAIMED BY TRUEBLUE AND THE PROVIDERS TO THE FULLEST EXTENT PERMITTED BY LAW. THERE WILL NOT BE ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS CREATED BY A COURSE OF DEALING, COURSE OF PERFORMANCE OR TRADE USAGE. YOU ARE SOLELY RESPONSIBLE FOR OBTAINING, CONFIGURING AND MAINTAINING ALL COMPUTER HARDWARE, SOFTWARE, TELEPHONE SERVICES, AND OTHER EQUIPMENT AND SERVICES NECESSARY FOR YOU TO USE THE SERVICES.

THE INTERNET IS NOT A SECURE MEDIUM, MAY BE SUBJECT TO INTERRUPTION, DISRUPTION, OR INADVERTENT OR DELIBERATE BREACHES OF SECURITY OR PRIVACY. You are responsible for using appropriate software to meet your particular requirements for anti-virus protection and accuracy of data and output, as well as for backing up your data independent from the Services. WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A BREACH OF SECURITY OR PRIVACY, OR FOR ANY VIRUS, MALICIOUS CODE, HACK OR CYBER ATTACK THAT AFFECTS THE SERVICES OR YOUR COMPUTER, DEVICE, PROGRAMS, OR DATA, DUE TO YOUR USE OF THE SERVICES. .

14. Limitation of Liability and Exclusive Remedy

WITHOUT LIMITING THE FOREGOING, IN NO EVENT WILL TRUEBLUE, ITS AFFILIATES OR SUBSIDIARIES, OR THE PROVIDERS’ TOTAL LIABILITY TO YOU OR ANY OTHER PERSON FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, OR COSTS, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, RELATED TO THIS AGREEMENT OR THE PRIVACY POLICY, OR UNDER ANY OTHER THEORY OF LAW OR EQUITY, AND REGARDLESS OF ANY NEGLIGENCE OR OTHER FAULT OR WRONGDOING BY TRUEBLUE OR ANY AFFILIATE OR PROVIDER OR ANY PERSON FOR WHOM TRUEBLUE OR ANY AFFILIATE OR PROVIDER IS RESPONSIBLE, EXCEED TEN US DOLLARS ($10) OR THE ACTUAL DAMAGES SUSTAINED BY YOU FROM YOUR USE OF THE SERVICES, WHICHEVER IS GREATER. YOU AGREE THAT THE DAMAGE EXCLUSIONS IN THIS AGREEMENT AND THIS LIMITATION OF LIABILITY AND EXCLUSIVE REMEDY SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. Some states and jurisdictions do not allow the exclusion of liability for certain damages, so some of the limitations above may not apply to you, in which case TrueBlue and the Providers’ liability shall be limited to the maximum extent permitted by applicable law.

15. No Incidental, Consequential, or Certain Other Damages

TRUEBLUE AND THE PROVIDERS WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY LOSS OF USE, LOSS OF PRODUCTION, LOSS OF INCOME OR PROFITS OR OPPORTUNITY (ANTICIPATED OR OTHERWISE), LOSS OF MARKETS, ECONOMIC LOSS, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE OR EXEMPLARY OR PUNITIVE DAMAGES, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR UNDER ANY OTHER THEORY OF LAW OR EQUITY, ARISING FROM, CONNECTED WITH, OR RELATING TO THE USE OF THE SERVICES BY YOU OR ANY OTHER PERSON, AND REGARDLESS OF ANY NEGLIGENCE OR OTHER FAULT OR WRONGDOING BY TRUEBLUE OR ANY AFFILIATE OR PROVIDER OR ANY PERSON FOR WHOM TRUEBLUE OR AN AFFILIATE OR PROVIDER MAY BE RESPONSIBLE, AND NOTWITHSTANDING THAT TRUEBLUE OR ANY PROVIDER MAY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES BEING INCURRED BY YOU OR ANY OTHER PERSON.

TRUEBLUE AND THE PROVIDERS WILL NOT BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY LOSS OR DAMAGES SUFFERED BY YOU OR ANY OTHER PERSON AS A RESULT OF ANY FAILURE OR REFUSAL BY TRUEBLUE TO GIVE EFFECT TO, OR FOR ANY FAILURE OR DELAY BY TRUEBLUE IN RECEIVING, ACCESSING, PROCESSING OR ACCEPTING, ANY COMMUNICATION SENT TO TRUEBLUE BY MEANS OF THE SERVICES OR OTHER FORM OF COMMUNICATION, OR FOR ANY LOSS OR DAMAGES SUFFERED AS A RESULT OF THE OPERATIONAL FAILURE, MALFUNCTION, INTERRUPTION, CHANGE, AMENDMENT OR WITHDRAWAL OF THE SERVICES.

16. Indemnification

You shall indemnify, defend, and hold harmless, each of TrueBlue, the Providers, and their respective partners, agents, directors, officers, employees, and all other related associated, or connected persons (collectively, the “Indemnified Parties”) from and against any and all liabilities, damages, fines, penalties, judgments, awards, losses, expenses and costs, including without limitation attorneys’ fees, in connection with any claim or demand arising out of, related to, or connected with your use of the Services or your breach of this Agreement. Without limiting the foregoing, the Indemnified Parties shall have the right to select their own counsel at your cost if they believe that there is an actual or potential conflict of interest. You may not enter into any settlement on behalf of any of the Indemnified Parties without the Indemnified Parties’ written consent. You agree to assist and cooperate as fully and reasonably required by the Indemnified Parties in the defense of any claim or demand.

17. Intellectual Property

TrueBlue and our licensors retain full ownership, intellectual property rights and protection in all material contained in the Services including, but not limited to, all digital images, software, source code and other code, or business methods. Subject to the terms of this Agreement, you are granted a limited, non-sublicensable, revocable license to access and use the Services for lawful informational related purposes only. Access and use of any content, information and related materials that may be made available through the Services is made available solely for your personal use. Except as otherwise expressly provided in this Agreement, you may not copy, distribute, transmit, display, perform, reproduce, publish, license, rewrite, modify, create derivative works from, download (other than the page caching), transfer or sell any material contained within the Services, or use the Services other than for their intended purpose without the prior consent of TrueBlue or the respective owner. 

The Services may only be used in the manner described expressly in this Agreement. In particular, except as expressly stated otherwise in this Agreement, you may not copy, imitate, reproduce, republish, link to, upload, post, transmit, modify, index, catalogue, mirror or distribute in any way, in whole or in part the Services, nor cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, nor otherwise data mine any portion of the Services or unduly burden or hinder the operation and/or functionality of any aspect of the Services, without the express prior written consent of TrueBlue.

TRUEBLUE, the TrueBlue logo, and other marks and logos appearing within the Services are registered or unregistered trademarks, trade names, or service marks owned or licensed by TrueBlue. Other product and company names and logos appearing within the Services may be registered or unregistered trade names, trademarks or service marks of their respective owners. Any use of the trade names, trademarks, service marks, or logos (collectively “Marks”) displayed on the Services is strictly prohibited. Nothing appearing within the Services or elsewhere shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Marks displayed within the Services.

Any rights not expressly granted herein are reserved by TrueBlue, the Providers, and their respective licensors.

17 U.S.C. 512(c)(3) sets forth the requirements for proper notification. However, if you knowingly misrepresent that the material or activity is infringing, you may be liable for any and all damages incurred by TrueBLue or its Providers as a result of our relying upon such misrepresentation. Also, in accordance with the DMCA, TrueBlue has also adopted a policy of terminating, in our sole discretion, users who are deemed to be repeat infringers or we may limit access to the Services and/or immediately terminate the accounts of users who infringe any intellectual property rights of others. 

18. Digital Millennium Copywright Act (“DMCA”) Notice  

If you believe any material in the Services infringes on a copyright you own or control, you may file a notification of infringement by calling (253) 383-9101, by emailing legaldepartment@trueblue.com, or by mailing such notice to TrueBlue, Attention: Legal Department, 1015 A Street, Tacoma, Washington, 98402.

19. Other Sites

The Services includes links to other websites, resources, and businesses operated by our Providers or other persons (collectively, “Other Sites”). 20. Linking, Framing, Mirroring, and Data-Mining the Services

Links to the Services without the express written permission of TrueBlue are strictly prohibited. The framing, mirroring, scraping or data mining of the Services or any of its content in any form and by any method are strictly prohibited.

21. Termination of This Agreement and the Services

TrueBlue may, at any time and for any reason and in its sole discretion: (a) change, suspend or terminate, temporarily or permanently, the Services or any part of it; or (b) restrict, suspend or terminate, in whole or in part, your permission to access or use the Services; all without any notice or liability to you or any other person. If this Agreement or your permission to access or use the Services is terminated, then: (a) this Agreement and all other then existing agreements between TrueBlue and any persons you represent will continue to apply and be binding regarding your prior access to and use of the Services, and anything connected with, related to or arising therefrom; and (b) TrueBlue may continue to use and disclose your personal information in accordance with the Privacy Policy as amended from time to time. If you breach any provision of this Agreement, you may no longer use the Services. All sections which by their nature should survive the termination of this Agreement shall continue in full force and effect subsequent to and notwithstanding the termination of this Agreement.  

22. Governing Law and Dispute Resolution  

The Services are controlled by TrueBlue from Tacoma, Washington, United States of America. This Agreement, your use of the Services, and all related matters are governed solely by the laws of the state of Washington, United States of America and applicable federal laws of the United States of America, excluding any rules of private international law or the conflict of laws that would lead to the application of any other laws. Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules which may be found at https://www.adr.org/aaa/ShowProperty?nodeId=/UCM/ADRSTG_004103&revision=latestreleased, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The arbitration will be before a single arbitrator. The place of arbitration will be Tacoma, Washington, United States of America.

You hereby relinquish, forfeit, and give up the right to resolve any controversy or claim arising out of or relating to this Agreement by a judge and/or a jury. Notwithstanding any provision in this Agreement to the contrary, TrueBlue may seek injunctive relief in any court having jurisdiction over the parties to enjoin or prevent any action you take or threaten to take in violation of this Agreement.

You agree that arbitration in no way limits the relief that any party may seek in the jurisdiction in which arbitration has been filed. EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. Further, unless both TrueBlue and you agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

To the extent permitted by law, any claim or cause of action you may have arising from, connected with, or related to your use of the Services, this Agreement, or any related matters must be commenced within one (1) year after the claim or cause of action arises, after which time the claim or cause of action is forever barred, regardless of any statute or law to the contrary. 

23. Miscellaneous 

If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, such determination will not affect the validity of any other provision and the provision in question shall be reformed to reflect the intent of the provision to the greatest extent possible.

Notwithstanding anything herein to the contrary, all provisions necessary for their interpretation or enforcement, will survive indefinitely after the termination of this Agreement and remain in full force and effect and be binding upon the parties as applicable. The provisions of this Agreement will inure to the benefit of and be binding upon each of TrueBlue and the Providers and each of their respective successors and assigns and related persons, and you and your heirs, executors, administrators, successors, and personal representatives, and all persons you represent and their respective successors, assigns and related persons. You and the persons you represent may not assign this Agreement or the rights and obligations under this Agreement without the express prior written consent of TrueBlue, which may be withheld in TrueBlue’s discretion. TrueBlue may assign this Agreement and its rights and obligations under this Agreement without your consent or the consent of any persons you represent.

No consent or waiver, by any party, to or of any breach or default by any other party in its performance of its obligations under this Agreement will be deemed or construed to be a consent to or waiver of a continuing breach or default or any other breach or default of those or any other obligations of that party. No consent or waiver will be effective unless in writing and signed by all parties. Any rights not expressly granted by this Agreement are reserved to TrueBlue.

TrueBlue reserves the right to inform law enforcement of any illegal activity or material we suspect or discover on, through, or otherwise related to the Services and to provide law enforcement officials with all requested information about the user account from which the illegal activity or material originated.

TrueBlue may use the personal information we collect, use, and process to: 

  • Provide TrueBlue Services to our workforce and our clients
  • Process employment applications for positions you may apply for with TrueBlue or TrueBlue clients
  • Match candidates and TrueBlue clients with job opportunities, including using geographic or location data to determine an individual’s proximity to a worksite or job location/opportunity

Purchase Order Terms & Conditions

TrueBlue Purchase Order Terms & Conditions

THESE PURCHASE ORDER TERMS AND CONDITIONS (“P.O. Terms”) shall govern the purchase of goods (“Goods”) and/or services (“Services”) by TrueBlue, Inc., on behalf of itself and its subsidiaries and affiliates (“TrueBlue”) from the seller (“Seller”) named in the purchase order (“Purchase Order”) accompanying these terms. Notwithstanding anything herein to the contrary, if a written contract signed by both parties is in existence regarding the sale of the Goods and/or Services, the terms and conditions of such contract shall prevail to the extent they are inconsistent with these P.O. Terms.

  1. Delivery of Goods. Seller shall deliver the Goods in the quantities and on the date(s) specified in the Purchase Order (the “Delivery Date”). If Seller fails to deliver the Goods in full on Delivery Date, Buyer may terminate the Purchase Order immediately by providing written notice to Seller. Seller shall deliver all Goods to the address specified in the Purchase Order (the “Delivery Point”) during Buyer’s normal business hours or as otherwise instructed by Buyer. Seller shall package all goods for shipment in accordance with Buyer’s instructions or, absent Buyer instructions, in a manner sufficient to ensure
    Goods are delivered undamaged.
  2. Performance of Services. Seller shall (a) obtain, and at all times of this Purchase Order maintain, all necessary licenses and consents and comply with all relevant laws applicable to provision of Services; (b) comply with all rules, regulations, and policies of Buyer, including security procedures concerning systems and data and remote access thereto, building security procedures, and general health and safety practices and procedures; (c) maintain complete and accurate records relating to provision of the Services under Purchase Order and, during the term of the Purchase Order and for period of two (2) years thereafter, upon Buyer’s written request, Seller shall allow Buyer to inspect and make copies of such records in connection with provision of the Services; and (d) obtain Buyer’s written consent prior to
    entering into agreements with any person or entity to provide Services to Buyer (a “Subcontractor”), and Seller shall remain fully responsible for the perform of each Subcontractor and its employees and for their compliance with all of the terms and conditions of this Purchase Order as if they were Seller’s own employees.
  3. Shipping Terms, Title, and Risk of Loss. Delivery of Goods shall be made in accordance with the shipping terms in the Purchase Order. The Purchase Order number must appear on all shipping documents, shipping labels, invoices, correspondence and any other documents pertaining to the Purchase Order. Title and risk of loss passes to Buyer upon delivery of Goods at the Delivery Point.
  4. Inspection and Right to Reject Nonconforming Goods. Buyer has the right to inspect the Goods on or after the Delivery Date. Buyer, at its sole option, may inspect all or a sample of the Goods, and may reject all or any portion of the Goods if it determines the Goods are nonconforming or defective. If Buyer rejects any portion of the Goods, Buyer has the right, effective upon written notice to Seller, to: (a) rescind this Agreement in its entirety; (b) accept the Goods at a reasonably reduced price; or (c) reject the Goods and require replacement of the rejected Goods. If Buyer requires replacement of the Goods, Seller shall, at its expense, promptly replace the nonconforming or defective Goods and pay for all related expenses, including, but not limited to, transportation charges for the return of the defective goods and the delivery of replacement Goods. If Seller fails to timely deliver replacement Goods, Buyer may replace them with goods from a third party and charge Seller the cost thereof and terminate this Agreement for cause. Any inspection or other action by Buyer under this Section shall not reduce or otherwise affect Seller’s obligations under the Agreement, and Buyer shall have the right to conduct further inspections after Seller has carried out its remedial actions.
  5. Price and Payment Terms. The price of the Goods and/or Services is the price stated in the Purchase Order (“Price”). If no price is included in the Purchase Order, Price shall be the price set out in Seller’s published price list in force as of the date of Purchase Order. Unless otherwise stated in Purchase Order, the Price includes all packaging, transportation to Delivery Point, insurance, custom duties, fees, and applicable taxes. No Price increase is effective without Buyer’s written consent. Seller shall issue an invoice to Buyer on or any time after completion of delivery in accordance with these P.O. Terms, and Buyer shall pay all properly invoiced amounts due to Seller within forty-five (45) days after Buyer’s receipt of invoice, except for any amounts disputed in good faith. Unless otherwise stated in Purchase Order, all payments shall by in U.S. dollars. Without prejudice to any other right or remedy it may have, Buyer reserves the right to set off at any time any amount owning to it by Seller against amount payable by Buyer to Seller. In event of a payment dispute, Buyer shall deliver a written statement to Seller no less than ten (10) days prior to the date payment is due on the disputed invoice listing all disputed items and providing a reasonably detailed description of each disputed item. The parties shall seek to resolve all such disputes expeditiously and in good faith, and Seller shall continue performing its obligations under the Purchase Order notwithstanding such dispute.
  6. Termination. In addition to any remedies that may be provided under these P.O. Terms, Buyer may terminate Purchase Order with immediate effect upon written notice to the Seller, either before or after the acceptance of the Goods or the seller’s delivery of the Services, if Seller has not performed or complied with any of these P.O. Terms, in whole or in part. If the Seller becomes insolvent, files a petition for bankruptcy or commences or has commenced against it proceedings relating to bankruptcy, receivership, reorganization or assignment for the benefit of creditors, then the Buyer may terminate the Purchase Order upon written notice to Seller. If Buyer terminates the Purchase Order for any reason, Seller’s sole and exclusive remedy is payment for the Goods received and accepted and Services accepted by Buyer prior to the termination.
  7. Warranties. Seller warrants to Buyer that for a period of twelve (12) months from Delivery Date, all goods will: (a) be free from any defects in workmanship, material, and design; (b) conform to applicable specifications, drawings, designs, and other requirements provided in writing by Buyer; (c) be fit for their intended purpose and operate as intended; (d) be merchantable; (e) be free and clear of all liens, security interests, and other encumbrances; and (f) not infringe or misappropriate any third party’s intellectual property right.
  8. Indemnification and Insurance. Seller shall indemnify, defend, and hold harmless Buyer from and against all losses, damages, and liabilities, expenses of whatever kind, including reasonable attorneys’ fees and the cost of enforcing any right to indemnification hereunder and the cost of pursuing any insurance providers related to or arising out of Seller’s: (a) provision of the Services; (b) delivery of Goods; (c) infringement of any patent, copyright, trademark or other intellectual property right; or (d) negligence or willful misconduct. During the term of this Purchase Order, Seller shall, at its own expense, maintain and carry insurance in full force and effect which includes but is not limited to: commercial general liability (including product liability) in a sum no less than $1,000,000 per occurrence and $5,000,000 in the aggregate. Upon Buyer’s request, Seller shall provide Buyer with a certificate of insurance from Seller’s insurer evidencing the insurance coverage specified in these P.O. Terms. The certificate of insurance shall name Buyer as an additional insured.
  9. Compliance with Laws and TrueBlue Code of Conduct. Seller shall comply with all applicable laws, regulations, and ordinances. Seller shall maintain in effect all the licenses, permissions, authorizations, consents, and permits Seller needs to carry out its obligations under the Purchase Order. Seller shall comply with all export and import laws of all countries involved in the sale of Goods under the Purchase Order. Supplier shall comply with the TrueBlue Code of Conduct and Business Ethics for Third Parties.
  10. Confidential Information. All non-public, confidential, or proprietary information of Buyer, including but not limited to business plans, customer data, marketing strategy, financial information, employee data, compensation information, sales, suppliers, investors, contracts, trade secrets, know-how, inventions, software programs, applications, documentation, designs, drawings, programs, formula or test data, and work in progress, disclosed by Buyer to Seller, whether disclosed orally or in written, electronic or other form or media, is confidential, solely for the purpose of performing the Purchase Order and may not be disclosed or copied unless authorized in advance by Buyer in writing. Upon Buyer’s request, Seller shall promptly return all documents and other material received from Buyer. Buyer shall be entitled to seek injunctive relief for any violation of this provision. This provision does not apply to information that is (a) in the public domain; (b) known to Seller at the time of disclosure; or (c) rightfully obtained by Seller on a non-confidential basis from a third-party.
  11. Governing Law. The Purchase Order and P.O. Terms shall be governed by and construed under the laws of the State of Washington, United States of America, excluding its conflict of laws rules.
  12. Survival. Provisions of these P.O. Terms which by their nature should apply beyond their terms will remain in force after any termination or expiration of the Purchase Order or P.O. Terms, including, but not limited to: Indemnification and Insurance, Compliance with Laws and TrueBlue Code of Conduct, Confidential Information, Governing Law, and Survival.
  13. Miscellaneous. The relationship between the parties is that of independent contractor, and nothing contained in the Purchase Order or P.O. Terms shall be construed as creating any agency, partnership, or other form of joint enterprise, employment or relationship between the parties. No waiver by Buyer of any of the provisions of the Purchase Order or P.O. Terms is effective unless explicitly set forth in writing and signed by Buyer. No failure to exercise, or delay in exercising, any right, remedy, power or privilege
    arising from the Purchase Order or P.O. Terms operates, or may be construed, as a waiver thereof. Terms may only be amended or modified in a writing stating specifically that it amends these P.O. Terms and is signed by an authorized representative of each party.

TrueBlue Supplier Code of Conduct

Purpose & Applicability

TrueBlue, Inc., on behalf of our subsidiaries and affiliates (“TrueBlue”), is successful because of our commitment to our core values and highest standards of ethical conduct. Ethics and compliance form the foundation of TrueBlue’s global business activities and are at the forefront of every business decision we make and every action we take. This foundation is dependent upon the integrity of not only our team members, but also our business partners.

TrueBlue has provided this Supplier Code of Conduct (the “Code”) to our suppliers as a way to communicate our expectations for ethical and lawful conduct. The Code is a set of fundamental principles. We require our suppliers to comply with the contents in the Code, with the letter and spirit of applicable laws and regulation, and to always engage in the highest standards of ethics.

The Code applies to all suppliers and their employees providing products or services to TrueBlue (“Suppliers”). The provisions of this Code are in addition to, not in lieu of, the provisions of any legal agreement or contract between Supplier and TrueBlue. We expect Suppliers to hold their supply chain, including subcontractors and third party labor agencies, to the same standards contained in this Code.

This Code may be amended by TrueBlue from time to time. The enforcement and/or interpretation of the Code rests solely with TrueBlue and does not confer or create any rights in favor of any party other than TrueBlue.

Compliance with Laws & Regulations

Suppliers shall comply with all applicable laws and regulations in the jurisdictions and countries in which they operate and/or conduct business with TrueBlue, including but not limited to all applicable laws and regulations concerning:

  • Labor and Employment (including wage and hour laws, legally mandated minimum wage and
  • benefits requirements, and employee break and meal periods);
  • Trade (including all applicable trade controls and export and import laws);
  • Fair competition and antitrust;
  • Privacy and data protection;
  • Environment; and
  • Anti-corruption.

Labor Practices & Human Rights

Suppliers shall conduct their activities in a manner that respects human rights, equal opportunity, and complies with all applicable laws, rules and regulations regarding labor, employment, and human rights, including but not limited to:

  • Involuntary Labor, Human Trafficking, and Slavery. Suppliers shall not use any form of forced labor, including but not limited to any form of slave, forced, bonded, indentured, or involuntary prison labor. Supplier is prohibited from engaging in or supporting in any form any human trafficking or labor through threat, force, fraud, exploitation or coercion. Work must be voluntary and Supplier employees and workers must be free to leave work and/or terminate their employment upon notice to Supplier.
    Modern Slavery Act 2015. TrueBlue subsidiaries are incorporated in the United Kingdom and procure goods and services from Suppliers in the United Kingdom. Any Suppliers performing services or supplying goods in the United Kingdom shall: (a) implement due diligence procedures for its own suppliers, subcontractors and participants in its supply chains to ensure there is no slavery or human trafficking in its supply chains; (b) respond promptly to any slavery and human trafficking due diligence questionnaires issued by TrueBlue and ensure the accuracy and completeness of such responses; (c) notify TrueBlue as soon as it becomes aware of any actual or suspected slavery or human trafficking in its supply chain in connection with the services or products provided to TrueBlue. Furthermore, any Suppliers providing goods or services to TrueBlue in the United Kingdom represent and warrant that neither Supplier nor any of its officers or employees have ever been convicted of any offense involving slavery or human trafficking nor been the subject of any investigation, inquiry, or enforcement proceedings by any government, administrative, or regulatory body regarding any offense in connection with slavery or human trafficking.
  • Child Labor and Minimum Working Ages. Suppliers shall only engage and employ workers in compliance with all local and national minimum working age laws or regulations. Suppliers shall not use child labor. Suppliers must only employ workers who are the greater of: (a) fifteen (15) years of age; (b) the age for completion of mandatory education; or (c) the minimum age to work in the jurisdiction where work is performed.
  • Wages and Benefits. Suppliers shall pay their workers all compensation, and benefits, which meet and comply with all applicable laws.
  • Workers Right to Documentation. Suppliers shall ensure their workers have access to work-related documents. Suppliers shall not require workers to surrender any government-issued identification, passports, or work permits as a condition of working, and Suppliers shall only temporarily maintain custody over such documents for administrative purposes.
  • Non-Discrimination. Suppliers shall not discriminate in any way on the basis of race, color, sex, national origin, gender, gender identity/expression, sexual orientation, religion, disability, age, political opinion, marital/family status pregnancy, veteran status, or other similarly protected factors in Suppliers’ hiring, compensation/wage/benefits, training, promotion, or termination decisions or policies.
  • Non-Harassment and Safe Workplace. Suppliers shall not engage or permit any (a) harassment, including sexual harassment; (b) physical, verbal, or psychological abuse; or (c) any threats of violence, physical abuse or other forms of intimidation.
  • Working Hours. Suppliers shall not allow workers to work more than the maximum hours of daily and weekly labor set by applicable local and national laws and regulations. All overtime shall be voluntary and paid in accordance with applicable laws. Except for emergencies or unique situations, Suppliers shall not require workers to work more than 60 hours in a week (including overtime) and Suppliers shall provide worker at least one day off for every 7 day period.
  • Employee Records. Suppliers shall maintain all employment records in compliance with all applicable local and national laws. Supplier shall provide workers with documentation explaining the basis on which workers are paid.
  • Freedom of Association. Suppliers shall respect workers’ freedom of association and collective bargaining rights in compliance with applicable local and national laws and regulations.

Health & Safety

Suppliers shall comply with all applicable workplace health and safety laws and regulations in the jurisdictions in which they operate. Suppliers shall utilize health and safety management policies and practices into its business, including but not limited to policies and practices as applicable that address: compliance with all applicable occupational health and safety laws; providing a safe workplace for workers; training workers on workplace health and safety; emergency preparedness; industrial hygiene; physically demanding work; machinery safeguarding; sanitation, food, and housing.

Ethics & Business Practices

Suppliers shall conduct their business activities with the utmost integrity and ethical practices, including
but not limited to:

  • Anti-Corruption. Suppliers shall comply with all applicable local and national anti-corruption laws, including but not limited to the United States Foreign Corrupt Practices Act (FCPA) and UK Bribery Act. Suppliers shall not participate in any bribes or kickbacks of any kind in dealing with public officials or individuals in the private sector. Supplier personnel are prohibited from directly or indirectly making, promising, authorizing or offering anything of value to a foreign government official on behalf of TrueBlue to secure an improper advantage, obtain or retain business, or direct business to any other person or entity. This prohibition includes payments to third parties where Supplier personnel know, or should have reason to know, that the third party will use any part of the payment to distribute anything of value to a foreign government official.
  • Gifts. TrueBlue policy strictly prohibits actual or potential conflicts of interest stemming from the offer and/or acceptance of gifts, items of value, or personal gain made by any third party to TrueBlue employees and/or their family members in order to secure a business advantage. Suppliers shall avoid giving gifts or anything of value to TrueBlue and its employees in order to obtain or retain an advantage or benefit for the giver, or anything that might appear to influence, compromise judgement or obligate TrueBlue or any of its employees. Supplier shall never offer any gifts in the form of cash or cash equivalents. Suppliers shall never offer, promise, or give any gifts during the vendor selection process or contract negotiations. Any gift, meal or entertainment must be in good taste, in moderation, never harm TrueBlue’s reputation, reasonable, proportionate and not extravagant or excessive. Any gift, meal or entertainment must comply with TrueBlue’s permissible gift amount policy.
  • Conflicts of Interest and Disclosure of Risks. Suppliers shall not deal directly with any TrueBlue employee whose spouse, domestic partner, or other family member or relative holds a significant financial interest in the Supplier. Any transaction with a Supplier that involves a spouse, domestic partner, or other family member or relative of a TrueBlue employee shall comply with TrueBlue’s Related Party Transactions Policy.
  • Insider Trading. Suppliers’ employees, representatives, and agents shall not buy or sell TrueBlue or another company’s securities when in possession of information about TrueBlue or another company that is not available to the public and could influence an investor’s decision to buy or sell such security.
  • Accounting and Business Records. Suppliers shall maintain accurate and honest records and reporting of all business information. Suppliers shall comply with all applicable laws and regulations in its maintenance of accurate, complete, and honest records.

Environmental Practices

Suppliers shall commit to protecting the environment and responding to the challenges posed by climate changes, including but not limited to:

  • Compliance. Suppliers shall comply with all applicable environmental laws and regulations regarding hazardous material, emissions, and waste/wastewater discharge. Suppliers shall obtain and maintain all necessary environmental permits and registrations. Suppliers shall comply with any environmental reporting obligations required by applicable law.
  • Reduction of Waste. Suppliers shall endeavor to use policies and procedures to reduce its waste, water, and energy consumption.
  • Hazardous Materials. Suppliers shall identify any hazardous materials or other materials posing a threat to the environment and take the steps to ensure the proper handling, movement, transportation, storage, use, and disposal of such materials.

Protection of TrueBlue Assets and Data

Suppliers shall take steps to safeguard TrueBlue’s intellectual property and confidential and/or sensitive information, including but not limited to:

  • Intellectual Property. Suppliers shall protect the intellectual property ownership rights of
    TrueBlue in its provision of services or products to TrueBlue. Suppliers shall only use information
    technology and software that has been legitimately acquired and sourced and which does not
    infringe on the intellectual property rights of third parties.
  • Privacy and Data Security. Suppliers shall comply with TrueBlue’s policies and procedures for
    maintaining confidentiality, privacy, and security when providing TrueBlue with goods or services
    or when accessing TrueBlue’s information technology system, corporate network, architecture, or
    physical areas.

Reporting & Questions

Suppliers are responsible for complying with laws and promptly raising concerns and reporting suspected or actual violations of the law, this Code or any unethical conduct. Suppliers can raise concerns or report suspected or actual violations anonymously, where permitted by law, to TrueBlue’s reporting resource, Compliance Alert at www.truebluecompliancealert.com or by phone in the United States and Canada at 855-70-alert.
